Duck Trading Co., Ltd. Dear Mr. Smith: Enclosed herewith please find our mediation statement recently submitted to the mediator. Per your request and our phone discussions, the statement has incorporated the several changes and additions (underlined in color for your easy reference) that you have agreed to. Further to our telephone discussion early this morning, this will confirm that your representative in Beijing and I are scheduled to meet in my office at the above-captioned address on Thursday, July 6, 2004 at 8:30 a.m. in order to get prepared for the mediation sessions. Please bear in mind that all mediations as practiced in China are supposed to be conducted in amicable and friendly atmosphere. Any argumentative remarks or rhetoric are considered taboo and should not be traded during the sessions.
